ETQA — Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ETQA mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

ETQA is a mobile application that allows users to scan product barcodes and view ingredient information categorized as halal, haram, or mashbooh (doubtful). The App is designed to assist users in making informed decisions about food products based on Islamic dietary guidelines.

The App may utilize third-party artificial intelligence (AI) services to analyze and classify ingredients. All AI-generated results are informational only and should not be considered definitive religious rulings.

3. Important Disclaimer Regarding Halal Classifications

Important Notice

The halal, haram, and mashbooh classifications provided in this App are for informational purposes only.

The classifications are based on general Islamic dietary principles and available ingredient data.
ETQA does not provide religious rulings (fatwas) and is not a substitute for consulting with qualified Islamic scholars or certification bodies.
Ingredient sourcing, manufacturing processes, and cross-contamination risks may affect the actual halal status of a product but may not be reflected in our data.
Different Islamic schools of thought may have varying opinions on certain ingredients.
Users are encouraged to verify information with certified halal organizations and consult with knowledgeable religious authorities for definitive guidance.

ETQA assumes no responsibility for dietary decisions made based on the information provided in the App.

4. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security of your password and account.
Notify us immediately of any unauthorized use of your account.
Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Account Deletion

You may delete your account and all associated data at any time, directly within the app. To do so, open the ETQA app, go to your Profile, open Settings (Account Settings), and select Delete Account. When you delete your account, we will:

Delete your account information
Remove your scan history and favorites
Complete deletion within 30 days

If you are unable to access your account, you may also request deletion by contacting us at support@etqaa.org. Some information may be retained in anonymized or aggregated form for analytics purposes, or as required by law.

7. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to the App, other accounts, or computer systems.
Interfere with or disrupt the App's functionality or servers.
Reverse engineer, decompile, or disassemble any part of the App.
Use automated systems or software to extract data from the App.
Misrepresent your identity or affiliation with any person or entity.

8. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of ETQA and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the App without prior written consent from ETQA.

9. Data Accuracy

While we strive to provide accurate and up-to-date ingredient information:

Product formulations may change without notice.
Manufacturers may alter ingredients or sourcing.
Our database may not include all products or the most recent product information.
Barcode scanning accuracy depends on various factors including barcode quality and database coverage.
AI-powered ingredient analysis is provided on a best-effort basis and may not always be accurate.

Always check product packaging for the most current ingredient information.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

11. Third-Party Services

The App may contain links to or integrate with third-party services, websites, or applications, including AI language model providers used for ingredient analysis. ETQA is not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are solely between you and the third party.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR COMPLETENESS OF INFORMATION

ETQA DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ETQA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS, DATA, OR GOODWILL
SERVICE INTERRUPTION OR COMPUTER DAMAGE
DIETARY OR HEALTH-RELATED CONSEQUENCES FROM RELIANCE ON APP INFORMATION

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (IF ANY).

14. Indemnification

You agree to indemnify, defend, and hold harmless ETQA, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

15. Modifications to the App and Terms

ETQA reserves the right to:

Modify, suspend, or discontinue the App (or any part thereof) at any time without notice.
Update these Terms at any time. Changes will be effective upon posting the revised Terms in the App.

Your continued use of the App after any changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to its conflict of law provisions.

18. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution is not successful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ETQA regarding your use of the App and supersede any prior agreements.
